These Terms and Conditions set out the basis on which Rubbish Removal Marylebone provides rubbish clearance, junk collection, and related waste removal services within its service area. By booking or using our services, you agree to be bound by these Terms and Conditions. If you do not agree, you must not place a booking or proceed with any service.
In these Terms and Conditions, the following expressions have the following meanings:
Client means the individual, business, organisation, or other party requesting or receiving our services.
We, us, our means Rubbish Removal Marylebone.
Services means any rubbish removal, waste collection, waste loading, transport, and disposal services we agree to carry out for you.
Booking means a request for services that has been confirmed by us via email, text message, or verbal confirmation and for which a date and approximate time window has been agreed.
Waste means any items, materials, or substances that you ask us to collect, remove, or dispose of as part of the services.
Site means the address or location where the services are to be carried out.
We provide rubbish removal and waste collection services, including household clearances, office clearances, bulky item removal, and general non-hazardous waste disposal. The exact scope of services for each booking will be as agreed between you and us at the time of booking and confirmed in our quotation or confirmation message.
We reserve the right to refuse the collection or handling of any waste that we reasonably believe to be hazardous, prohibited, unlawful, or not in accordance with applicable waste management and health and safety regulations.
3.1 You may request a quotation and make a booking by phone, email, or through any other contact method we make available. You must provide accurate information about the nature, quantity, and location of the waste, as well as access conditions at the Site.
3.2 Any quotation we provide is based on the information you give us. If, on arrival, the waste is substantially different in type or quantity from what was described, or access conditions are significantly more difficult, we may adjust the price accordingly or decline to carry out part or all of the services.
3.3 A booking is only confirmed once we have accepted your request and provided a confirmation with a scheduled date and indicative time window. Any estimated arrival times are not guaranteed and may be subject to change due to traffic, delays, or operational factors. We will use reasonable efforts to inform you of any significant delays.
3.4 You must ensure that an authorised adult is present at the Site at the agreed time to grant access, confirm the waste to be removed, and approve any changes to the scope or price of the services.
4.1 You are responsible for ensuring that we have safe, clear, and reasonable access to the Site and to the waste that is to be collected. This includes arranging any parking permissions, entry codes, or permits needed for our vehicles and staff.
4.2 If we are unable to gain access to the Site at the agreed time for reasons beyond our control, this may be treated as a late cancellation and a call-out or cancellation fee may apply in accordance with these Terms.
4.3 You must ensure that all waste earmarked for removal is clearly separated from items you wish to keep. We will not be liable for any items removed in error if they were not clearly identified as not for removal.
5.1 Prices are generally based on the volume, weight, type of waste, labour involved, and access conditions. We may give you an initial estimate, which may be revised on Site once our team has inspected the waste and conditions.
5.2 Unless otherwise stated, prices include reasonable labour for loading and transport, and disposal or recycling fees for standard non-hazardous waste.
5.3 Where additional labour, equipment, or time is required, including but not limited to dismantling, carrying items over long distances, or navigating multiple flights of stairs, we reserve the right to charge additional fees, which will be explained to you before the work proceeds.
5.4 All prices are provided in pounds sterling and may be subject to applicable taxes as required by law.
6.1 Payment is due on completion of the services unless we have agreed alternative payment terms in writing prior to the booking date.
6.2 We accept payment by cash, debit or credit card, or other payment methods we may make available from time to time. We may require payment details to be provided at the time of booking to secure the appointment.
6.3 For business or account customers, invoices will be issued in accordance with agreed terms. Unless otherwise stated, invoices are payable within 14 days of the invoice date.
6.4 If payment is not received when due, we reserve the right to charge interest on the overdue amount at the statutory rate permitted under applicable UK legislation, as well as reasonable costs incurred in pursuing late payment.
6.5 We may suspend further services to you until all outstanding amounts, including any interest and charges, have been paid in full.
7.1 You may cancel or reschedule a booking by contacting us. To avoid charges, we require at least 24 hours notice before the scheduled arrival time.
7.2 If you cancel with less than 24 hours notice, or if we are unable to access the Site or perform the services at the agreed time due to your act or omission, we may charge a reasonable cancellation or call-out fee to cover our costs.
7.3 We reserve the right to cancel or reschedule a booking due to operational reasons, vehicle breakdown, severe weather, or circumstances beyond our reasonable control. If we cancel, we will offer an alternative appointment time. We will not be liable for any indirect loss or inconvenience resulting from such cancellation.
7.4 Any changes to the scope of services, including additional waste or different items, must be agreed with our team on Site and may result in a revised price.
8.1 We collect and dispose of general non-hazardous waste, including typical household and office rubbish, furniture, and bulky items, in accordance with applicable waste legislation.
8.2 We do not normally accept hazardous or specialist waste, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, oils, gas cylinders, explosives, or materials classified as hazardous under UK law. If such waste is presented for collection without prior agreement, we reserve the right to refuse it and charge for any wasted journey.
8.3 If you are unsure whether particular items are acceptable, you must inform us at the time of booking so that we can advise you. Additional charges may apply for certain items, such as fridges, freezers, mattresses, tyres, or electrical goods that require special handling.
8.4 You warrant that all waste presented for collection belongs to you or that you have full authority of the owner to arrange for its removal and disposal.
9.1 We operate in accordance with applicable UK waste regulations and aim to dispose of or recycle waste using properly licensed facilities. We will take reasonable care to ensure that all waste is transported and handled lawfully.
9.2 By using our services, you acknowledge your duty of care under relevant UK environmental legislation to ensure that waste is transferred only to an authorised carrier and managed responsibly. We act as your contractor to help you meet this obligation.
9.3 We may issue you with a waste transfer note or similar documentation where required by law or upon request. You should retain such documents for your records.
9.4 We shall not be responsible for any consequences arising from your failure to disclose the true nature of the waste or from any misrepresentation regarding its contents.
10.1 You agree to provide accurate information about the waste, access, and Site conditions, and to notify us of any relevant risks, including fragile surfaces, restricted access, or potential hazards.
10.2 You warrant that the waste does not contain any prohibited, illegal, or hazardous materials unless expressly agreed in writing in advance.
10.3 You are responsible for obtaining any permissions or consents necessary for us to access and work at the Site, including from landlords, managing agents, neighbours, or local authorities if required.
10.4 You must ensure that children, pets, and other persons are kept at a safe distance while we are working, and you must comply with any reasonable instructions given by our team for safety reasons.
11.1 We will exercise reasonable care and skill in providing the services. If we fail to do so, our liability shall be limited to either re-performing the services or refunding an appropriate proportion of the price paid, at our discretion.
11.2 We will not be liable for any pre-existing damage to your property, including driveways, flooring, walls, or fixtures, nor for damage arising from inherent defects or weaknesses in structures or items being removed.
11.3 Where we are requested to place vehicles or equipment on driveways, pavements, or other surfaces not suitable for heavy loads, you accept the risk of any damage that may occur and we shall not be responsible for such damage unless caused by our negligence.
11.4 We shall not be liable for any loss of profit, loss of business, loss of opportunity, loss of data, or any indirect or consequential loss arising out of or in connection with the services, whether based in contract, tort, or otherwise.
11.5 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.
11.6 If any items are removed in error due to them not being clearly identified as not for disposal, our liability will be limited to the reasonable cost of replacing such items on a like-for-like basis, subject to satisfactory evidence of value and ownership, and excluding sentimental value or any indirect loss.
12.1 We maintain insurance appropriate to our activities as a rubbish removal contractor in the UK. Details of our insurance cover are available on request.
12.2 You are responsible for arranging any insurance necessary to cover your own property and belongings, including during the course of the services.
13.1 If you are unhappy with any aspect of our services, you should raise the issue with our team on Site where possible so that we have an opportunity to resolve it immediately.
13.2 If the issue cannot be resolved on Site, you should contact us as soon as reasonably practicable, providing full details of the complaint and any supporting information. We will investigate and respond within a reasonable timeframe.
13.3 We will attempt to resolve disputes amicably. If a dispute cannot be resolved through our internal process, both parties agree to consider informal dispute resolution methods before commencing court proceedings.
14.1 We shall not be liable for any delay or failure to perform our obligations under these Terms and Conditions where such delay or failure results from events beyond our reasonable control, including but not limited to severe weather, transport disruption, strikes, accidents, or acts of government.
14.2 If a force majeure event occurs, we will use reasonable efforts to notify you and to resume performance as soon as reasonably possible.
15.1 We will collect and process your personal information only for the purposes of managing bookings, providing services, taking payment, and communicating with you, in accordance with applicable UK data protection law.
15.2 By providing your contact details, you consent to us using them for legitimate business purposes related to the services. You may request that we update or remove your information where permitted by law.
16.1 We may update or amend these Terms and Conditions from time to time. Any changes will apply to bookings made after the revised terms have been published or communicated to you.
16.2 The version of the Terms and Conditions in force at the time of your booking will apply to that booking unless we agree otherwise in writing.
17.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.
18.1 These Terms and Conditions, and any non-contractual obligations arising out of or in connection with them, are governed by and construed in accordance with the laws of England and Wales.
18.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided.
19.1 These Terms and Conditions, together with any written quotation or confirmation we provide, constitute the entire agreement between you and us in relation to the services and supersede any prior agreements, understandings, or arrangements, whether written or oral.
19.2 You acknowledge that you have not relied on any statement, promise, or representation made or given by or on behalf of us that is not set out in these Terms and Conditions.
